Civil recovery is a global term for civil claims where businesses seek civil remedies,
from those who commit acts of wrongdoing on their premises, where loss and damage
arise, consequential to the act of wrongdoing. The law provides for those businesses
to seek damages from those who commit acts of wrongdoing (known as torts), by way
of a claim for damages. The law provides that damages can be awarded in order to
put the business back in the place it would have been in, had the tort not been
committed.
Where loss and damage arises involving members of staff, there is an additional
civil cause of action, for breach of contract.
Claims in tort and contract can be brought against any individual, irrespective
of any criminal proceedings.
Our staff, our IT systems and our practices and procedures have been developed in
order to capture all of the necessary information from clients reporting from the
outset, swiftly and efficiently; but with sufficient detail to demonstrate the claim
to a Court, which is required on the balance of probability, which would ultimately
be required by a Court in order for a claim to succeed. Where a claim is defended,
the claim is investigated by our legal department with additional liaison with the
client and the Defendant to obtain further detail and evidence to achieve a conclusion.
This approach gives the maximum level of protection to clients’ brands.
