To obtain verification of a wrongdoer’s personal details or accurate details if the individual has provided a false name and address is as per the below, however, the release of information is at the discretion of the Police.

  1. Schedule 35(2) of the Data Protection Act 1998 states that personal data are exempt from non-disclosure provisions where this is necessary for any legal proceedings or to obtain legal advice or for establishing, exercising or defending legal rights.
  2. Personal Data may be exchanged where required for the Prevention of Crime and the Detection of Wrongdoers. Civil Recovery is registered as a Crime Prevention scheme under the Data Protection Act. Every Company in the scheme is also registered under the “Purpose”. To prevent crime therefore Companies have a right to know the names and addresses of persons they apprehend.
  3. Home Office Circular 55/1998 to Chief Constables. This circular states that The Victim’s Charter 1996 still applies to Police Forces including the need to disclose the name and address of an wrongdoer to a victim if required for the purpose of instituting civil proceedings.
