Data Sharing
To obtain verification of a wrongdoer’s personal details or accurate details if
the individual has provided a false name and address is as per the below,
however, the release of information is at the discretion of the Police.
- Schedule 35(2) of the Data Protection Act 1998 states that personal data are exempt from non-disclosure provisions where this is necessary for any legal proceedings or to obtain legal advice or for establishing, exercising or defending legal rights.
- Personal Data may be exchanged where required for the Prevention of Crime and the Detection of Wrongdoers. Civil Recovery is registered as a Crime Prevention scheme under the Data Protection Act. Every Company in the scheme is also registered under the “Purpose”. To prevent crime therefore Companies have a right to know the names and addresses of persons they apprehend.
- Home Office Circular 55/1998 to Chief Constables. This circular states that The Victim’s Charter 1996 still applies to Police Forces including the need to disclose the name and address of an wrongdoer to a victim if required for the purpose of instituting civil proceedings.
